Last week I posted of seeing my first bear this year. With two beautiful cubs.  Seeing them from a comfortable distance.  I was in my truck.

Interest Rate Update

Last week’s economic reports came from several housing market areas, all of which showed some improvement over the past month.Conforming 30 year fixed mortgage rates are at 4.750%, 15 year fixed mortgage rates are at 4.000% and 5/1 adjustable mortgage rates are at 3.125%.

Jumbo mortgage interest rates continue to be consistently low and beneficial for the high end borrower. Jumbo 30 year fixed mortgage rates are at 5.375%, jumbo 15 year mortgage rates are at 5.000% and jumbo 5/1 adjustable mortgage rates are at 3.875%. Borrowers need jumbo mortgage loans for mortgage financing above the conforming loan limit which is $417,000.

Cooling Weather-Warming Market

Another great weekend winding up.  The brief snow-fluuries and showers the past few days didn’t dampen the kids spirits at the Easter Egg Hunt. Nor did it dampen real estate activity. Last Thursday while touring a client from Pampa we saw our first bear.  Beautiful big black mama with 2 of the samllest little cubs that I have ever seen.  Couldn’t have been more than a week old.  Then I had a nice Closing Friday and wrote a new Contract up to review on Sat.  Hope to submit that one on Monday and Close on the river house on Tuesday.  Things were sure hoppin’ over Easter.

Living with Wildlife presentation by Lonnie Brown on Thursday, Apr. 21 at 6:30 pm (or 7:00 ?) at the La Veta Public Library. Will discuss animal rights versus Ag. and property owners rights and how to co-exist in harmony.  Maybe we can get Lonnie to also give that presentation to our government officials as well.

Politics

Some County officials have put out the word that proof of water to build is  needed to protect the public and it won’t affect property values nor infringe on existing property rights.  hmmm.  Seems to me that getting a building permit may become much harder to do.   

La Veta officials are confirming rumors  that Marshall Wilburn has been removed from office and Deputy Vaughn has been layed-off.   One new depitty will be hired to replace them.  More on this later.

Water Proposal Comments

Lots of great comments have come in on all sides of the water-building permit issue.  I have posted many snippets down under Responses below the previous 2 posts.  You may want to look at them below.  The County does not propose any restriction on the initial buy/sale of land and full  disclosure of water source is already provided as required.   But County proposes a proof of water source when the owner later requests a building permit.  That water source would be one of the following 3 sources,   1. a community system“, or 2. approved haul/deliver contractor, or 3. a minimum  1 gal/min. private well.  While seemingly well intentioned, this resolution may require proof of water volume minimums from community systems,  proof of health dept. certificates from the as yet unidentified, un-approved,  bulk-water hauler/providers or if water source is your own private well water, then water volume amounts up to 5 times the actual daily consumption uses with no credit for conservation, rain-collection, cisterns, occassional occupancy use- limited needs, etc.

 This solution seems to be dis-proportionate to the size of the perceived  existing problem. Due to its far-reaching implications, it could cause an artificial change in real estate values, as well as causing an economic hardship on land-owners and builders by its change in building permits and uses. This may in turn affect the sales, development, zoning and property tax valuation receipts for the County.   Full disclosure is always encouraged and that’s why we post this stuff.  But new after-the-fact water requirements in building permit regulations may hurt folks more than it helps them.  

No action was voted upon at last week’s Meeting. Presumably the Resolution will be acted upon at an upcoming regular Huerfano Commissioners Meeting. I personally hope we get a more modest and thoughtful approach to the issue considering the ramifications of their proposal.  Express your own opinion to them by phone or email and if possible attend their upcoming meeting when it appears on the Agenda.

Building Permits tied to Water Source

Huerfano County Commissioners held a Public Comment meeting yesterday regarding a new proposed regulation to be adopted requiring proof of existing potable water source before obtaining a new Building Permit. Community systems and water-haulers would have their own criteria requirements. If a private well, it must be shown to produce a min. of 1 gpm (over 1,400 gal per day). Records are not readily available, but experience tells us that many domestic wells produce less than 1,000 gal/day and are deemed adequate to their users.  About a dozen public citizens were in attendance at the public meeting. I attended along with two other area Realtors. 
 
In response to questions, Commissioner Roger Cain explained that public restrictions were needed due to Health Dept. concerns regarding bulk-delivery water providers and due to abuses at the Malachite Spring near Gardner. Thus the broad sweeping county-wide proposal.  Several in the audience spoke out against the proposal. No one spoke in favor of the new proposal.
 
 The ramifications of the proposed Resolution seem quite extensive and appear to adversely restrict rather than protect the citizens. Realtors already provide a Source of Water disclosure. This resolution could also be seen as limiting construction or development and hindering efforts to conserve water or rely upon rainwater collection systems, etc.  Land values could be greatly affected one way or the other as would uses, building permits and taxes.
